Medical Cannabis and Driving

Like all drivers, cannabis patients in Germany are allowed to drive as long as their medication does not impair their ability to operate a vehicle safely. Patients must be capable of driving safely without being compromised by their treatment.

Dr. jur. Marc Herzog
Attorney, specialist in traffic, criminal, and insurance law based in Rosenheim, and lecturer in criminal law, provides legal advice to cannabis patients on all questions related to driving ability.

Can Cannabis
Patients Drive?

Yes, cannabis patients can drive if they are able to do so safely. It is important not to drive for the first four to six weeks to allow the body to adjust to the medication. During this period, the doctor monitors the medication's effects and how the patient’s body reacts. Patients also learn to assess their own driving fitness. There are no strict rules, so patients should evaluate their ability to drive before each journey.

Adjustment Phase

During the adjustment phase, lasting about four to six weeks, patients should avoid driving.

Original Prescription

Cannabis patients are not required to carry special documentation, but it is recommended to keep a copy of the prescription or a doctor’s note during traffic stops.

Patient ID Card

Carrying a patient ID card is also a good option.

How Are Cannabis Patients Informed About Driving Fitness?

At the beginning of their treatment, patients receive a comprehensive information sheet, which they review with their doctor. This sheet covers all relevant aspects of driving fitness and the adjustment phase, including potential side effects that could impact driving safety, such as drowsiness, slowed reaction time, concentration difficulties, and dizziness. As with many other medications, it is advised to wait until the end of the adjustment phase before driving. A stable dosage and no physical or psychological impairments are required.
Patients must conduct a self-assessment before each drive, ensuring they are physically and mentally capable of driving safely.
